Resolution Changing the Date of Future General Elections

A RESOLUTION CHANGING THE DATE ON WHICH THE DALLAS COLLEGE HOLDS ALL FUTURE GENERAL ELECTIONS FOR THE PURPOSE OF ELECTING MEMBERS OF THE BOARD OF TRUSTEES TO THE NOVEMBER UNIFORM ELECTION DATE OF ODD-NUMBERED YEARS, IN ACCORDANCE WITH SENATE BILL 1494 (SIGNED INTO LAW ON JUNE 20, 2025).

WHEREAS, the 89th Texas Legislature met in regular session between January 14, 2025, and June 2, 2025;

WHEREAS, S.B. 1494, filed on February 20, 2025, was approved by both chambers of the Texas Legislature; and was signed into law by the Governor on June 20, 2025, with an immediate effective date;

WHEREAS, S.B. 1494, codified in Section 4 l.0052(a) of the Texas Election Code, allows the governing body of a political subdivision that holds its general election for officers on a date other than the November uniform election date to, not later than December 31, 2025, change the date on which it holds its general election for officers to the November uniform election date in odd-numbered years;

WHEREAS, Dallas College currently holds its general elections for the purpose of electing members of the Board of Trustees on the May uniform election date in even-numbered years; and

WHEREAS, The Board of Trustees of Dallas College has determined that it would serve the public interest to move its general election, as permitted by S.B. 1494, for the purpose of electing members of the Board of Trustees so that same will be held on the November uniform election date in odd-numbered years.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF DALLAS COLLEGE:

SECTION 1. That all general elections for the purpose of electing members of the Dallas College Board of Trustees, currently held in May of even-numbered years, will be held on the November uniform election date in odd-numbered years, beginning with the next regularly-scheduled general election to be held in November 2027.

SECTION 2. That the terms of the governing body shall be adjusted to begin and end on the November uniform election date, as well, with the currently elected members serving out the remainder of their current terms and holding over until the new election date in accordance with Section 41.0052(b) of the Texas Election Code. The terms of the Dallas College Board of Trustees shall be adjusted, as follows:

1. The terms of Trustees in Districts 5 & 6, which currently expire in May 2026, shall be extended until the November 2027 uniform election date;
2. The terms of Trustees in Districts 2, 3, & 4, which currently expire in May 2028, shall be extended until the November 2029 uniform election date;
3. The terms of Trustees in Districts 1 & 7, which currently expire in May 2030, shall be extended until the November 2031 uniform election date.

Section 3. Following completion of each of the lengthened, holdover terms, as described in Section 2, and the regularly-scheduled general elections for such Districts held on the applicable November uniform election date in odd-numbered years, as described in Section 2, each Trustee elected thereto shall serve six-year terms and the regularly-scheduled general elections for election of Dallas College Board of Trustees shall thereafter be held on the applicable November uniform election date in odd-numbered years.

SECTION 4. That this resolution shall take effect immediately after its passage.

RESOLUCION QUE MODIFICA LA FECHA EN QUE DALLAS COLLEGE CELEBRARA. TODAS LAS FUTURAS ELECCIONES GENERALES CON EL FIN DE ELEGIR A LOS MIEMBROS DE LA JUNTA DE SINDICOS PARA LA FECHA UNIFORME DE ELECCIONES DE NOVIEMBRE DE LOS ANOS IMPARES, DE ACUERDO CON EL PROYECTO DE LEY DEL SENADO 1494 (FIRMADO EL 20 DE JUNIO DE 2025).

CONSIDERANDO QUE, la 89.a Legislatura de Texas se reuni6 en sesi6n ordinaria entre el 14 de enero de 2025 y el 2 de junio de 2025;

CONSIDERANDO QUE, el S.B. 1494, presentado el 20 de febrero de 2025, fue aprobado por ambas camaras de la Legislatura de Texas y fue firmado por el Gobemador el 20 de junio de 2025, con fecha de entrada en vigor inmediata;

CONSIDERANDO QUE, el S.B. 1494, codificado en la Secci6n 41.0052(a) del C6digo Electoral de Texas, permite que el 6rgano de gobierno de una subdivision politica que celebre su elecci6n general en una fecha distinta a la fecha uniforme de noviembre, no mas tarde del 31 de diciembre de 2025, cambie dicha fecha por la fecha uniforme de noviembre en los aiios impares;

CONSIDERANDO QUE, actualmente Dallas College celebra sus elecciones generales con el prop6sito de elegir a los miembros de la Junta de Sindicos en la fecha uniforme de mayo en los afios pares;

CONSIDERANDO QUE, la Junta de Sindicos de Dallas College ha determinado que seria de interes publico cambiar la fecha de su elecci6n general, tal y como permite el S.B. 1494, para elegir a los miembros de la Junta de Sindicos para que se celebren en la fecha uniforme de noviembre en los afios impares.

AHORA, POR TANTO, SE RESUELVE POR LA JUNTA DE SINDICOS DE DALLAS COLLEGE:

SECCION 1. Que todas las elecciones generales destinadas a elegir a los miembros de la Junta de Sindicos de Dallas College, que actualmente se celebran en mayo de los afios pares, se celebraran en la fecha uniforme de elecci6n de noviembre en los afios impares, comenzando con la pr6xima elecci6n general programada para noviembre de 2027.

SECCION 2. Que los mandatos del 6rgano de gobierno tambien se ajustaran para comenzar y finalizar en la fecha uniforme de elecci6n de noviembre, con los miembros actualmente en funciones cumpliendo el resto de sus mandatos y manteniendose hasta la nueva fecha de elecci6n, conforme a la Secci6n 41.0052(b) del C6digo Electoral de Texas. Los mandatos de la Junta de Sindicos de Dallas College se ajustanin de la siguiente manera:

1. Los mandatos de los Fideicomisarios en los Distritos 5 y 6, que actualmente expiran en mayo de 2026, se prorrogaran hasta la fecha uniforme de elecci6n de noviembre de 2027;
2. Los mandatos de los fideicomisarios en los Distritos 2, 3 y 4, que actualmente expiran en mayo de 2028, se extenderan hasta la fecha uniforme de elecci6n de noviembre de 2029;
3. Los mandatos de los fideicomisarios en los Distritos 1 y 7, que actualmente expiran en mayo de 2030, se extenderan hasta la fecha uniforme de elecci6n de noviembre de

Seccion 3. Tras la finalizaci6n de cada uno de los mandatos prolongados y pendientes, segun se describe en la Secci6n 2, y las elecciones generales programadas regularmente para dichos distritos que se celebren en la fecha uniforme de elecci6n de noviembre en afios impares, segun lo dispuesto en la Secci6n 2, cada Sindico elegido para dicho cargo cumplira un mandato de seis afios, y las elecciones generales programadas regularmente para la elecci6n de la Junta de Sindicos de Dallas College se celebraran, en lo sucesivo, en la fecha uniforme de elecci6n de noviembre correspondiente a los afios impares.

SECCION 4. Que esta resoluci6n entrara en vigor inmediatamente despues de su aprobaci6n.
